Why this website Singapore Mediation Solutions?

The purpose of this website is to:

  1. Introduce mediation to the reader, expanding knowledge and opportunities for mediation in Singapore and beyond, and
  2. Connect readers to skilled mediators when desired, providing more opportunities to both readers and mediators.

Mediation helps preserve good jobs, ongoing business relationships, and earnings. Instead of working against each other, mediation can help your business find ways to work together in your best interests.

There are many excellent mediators in Singapore. Mediation can be helpful to find creative solutions to help grow your business, find practical ways forward, maintain relationships, at a relatively lower cost and higher speed than many alternatives.

What is Mediation?

Mediation is an interactive structured negotiation process, where an impartial third party mediator assists the parties to resolve their conflict by communicating with each other

All participants in mediation are encouraged to actively participate. Mediation is a process focused upon negotiating ways to best support the needs and interests of the parties.

The mediator uses a variety of techniques to guide the process and help the parties find their best practical solution. This is called “facilitative mediation” because the mediator facilitates communication between the parties and encourages interaction directed towards a positive, practical, and often creative solution.

How do I prepare for my Mediation?

Mediation ADR helps you Grow your Business in Singapore with Singapore Mediation Solutions by David Hoicka Licensed YayImages 30917284 800px WiThB81I .jpg?ik sdk version=javascript 1.4

1. If you have a lawyer working with you, discuss in advance with your lawyer

2. Consider what are your options and alternatives. You can bracket your negotiating range. For example, what is your best alternative (eg win at trial less expenses), and your worst alternative (eg lose at trial less expenses) to a negotiated settlement? How likely are they? This gives you a practical range for settlement.

3. Consider creative options to resolve your dispute. Often when the parties get together in Mediation, they can find new creative solutions for going forward.

4. Prepare and organize your paperwork and possible exhibits, for example relevant contracts, photographs, etc. Practice and rehearse what you want to say to the other side and to the Mediator

5. Get plenty of rest and sleep. Dress neatly preferably in fresh business attire. Arrive early.

How do I prepare my client for Mediation?

There are several steps for a lawyer to preparing your client for mediation, described briefly as follows:

1. Meet and discuss with your client to work out settlement options which are acceptable to the client. For example best case (eg winning less costs), worst case (losing less costs), and various creative options for resolution

2. Familiarize your client with mediation procedures and likely outcomes, as clients often have not participated in mediation before. For example, discuss with your client who does the talking in the mediation - client, lawyer, or both? and help the client prepare and practice what to say. Give client directions to mediation session, including possible parking so they can arrive early.

3. Prepare the written documents such as Mediation Statements which may be required by the Court or Mediation Agency. Assemble relevant exhibits, such as contracts, correspondence, photographs, etc.

4. Mediation can be an emotional event for clients, as they re-live possibly traumatic and life-altering events. Be prepared to give your client appropriate emotional support and direction, such as working through anger and frustrations, to achieve a workable solution the parties can live with, and perhaps prosper together with.

How do I engage a quality experienced Mediator?

Engaging a quality experienced Mediator helps resolve your issues. Often your goals in Mediation include, resolving the disagreement quickly, saving costs, protecting the relationship between the parties, finding a creative solution that benefits both parties.

For example, often in business there are time-critical decisions which need to be made, but well-meaning parties have honest differences of opinion. Confidential mediation with an experienced mediator can help you sort these issues out quickly and effectively, so you can go about your business profitably.
